Estate Planning

The estate plan we create for you will protect your hard-earned assets, maximize the tax laws to your utmost advantage to minimize taxes, and protect your children’s inheritance. Trusts and Trust Administration

Many people think you need to be wealthy to benefit from a trust, but the truth of the matter is that anyone with an estate in excess of $100,000 can benefit from a trust. Since the fair market value of a home is included in the value of an estate, most people would benefit from a trust. Trust Administration is the process by which the Trustee named in the Trust inventories the decedent’s assets, values the assets, reports the assets to the IRS for taxing purposes, prepares and files tax returns on behalf of the deceased and the Estate, and distributes the assets to the beneficiaries. Probate

Probate is the legal process of administering your estate, by distributing your valuables based on a valid will or according to the laws of the state. A well-planned estate plan makes probate much easier or avoids it altogether, and distributes your estate as you intended. Advanced Health Care Directives

An Advanced Health Care Directive is a legal document authorizing a person to make medical decisions on behalf of the person granting this authority (“Grantor”). Please remember that this document is only effective during the Grantor's lifetime. This may include authorizing medical treatment under various conditions, communicating with medical personnel, and fulfilling the Grantor's wishes regarding organ donation. (top)

Durable Power of Attorney

A Durable Power of Attorney is a legal document authorizing a person to act as an agent on behalf of the person granting the power of attorney (the "Grantor"). Again, this document is only effective during the Grantor's lifetime. We work with you to ensure that we provide the proper power of attorney as there are different types that grant greater or limiting authority depending upon the purpose of the document. Also, we can help keep these documents updated with accurate information in the event that addresses or nominated agents changes. (top)

Guardianships/Conservatorships

A guardian is a person appointed by a court to manage the affairs of another, either a minor or an adult, whom the court has determined to be incapacitated or otherwise unable to manage his or her own affairs. We can work with you to establish a guardianship or conservatorship to suit your needs. (top)
